1.1 The Service Provider provides an independent pre-purchase property evaluation service designed to assist prospective home buyers in evaluating residential properties before making a purchase decision.
1.2 The Service may provide an assessment of various aspects of a property, including, without limitation: layout and functional assessment; lifestyle-fit and space-usability assessment; Vastu assessment (where opted); and indicative resale-potential observations based on location, configuration and market factors.
1.3 The Service is intended to be an independent decision-support and property evaluation service. It is not intended to replace professional legal, financial, architectural, structural, valuation, taxation, title or other specialist advice.
1.4 The Service does not constitute a recommendation, representation, warranty or assurance that the Customer should purchase, not purchase, sell, invest in, or otherwise transact in relation to any property.
2.1 The Service Provider aims to provide an objective and independent assessment based on the information, documents, data and inputs available to it at the time of evaluation.
2.2 Unless expressly disclosed otherwise in writing, the Service Provider does not act as:
2.3 The Service Provider does not receive any commission, referral fee or other financial benefit from the purchase of the property merely because a Customer receives an assessment, unless expressly disclosed to the Customer.
3.1 Certain portions of the Service may use artificial intelligence, machine learning, algorithms, automated data processing or other technology ("AI Tools") to analyse information and generate observations.
3.2 The Service Provider may use human review, professional methodologies, proprietary frameworks or other validation processes in conjunction with AI Tools.
3.3 The Customer must independently verify material facts and information before making any purchase or financial decision.
4.1 The quality and accuracy of the assessment depend significantly on the accuracy, completeness and timeliness of information supplied by the Customer.
4.2 The Customer shall provide accurate and complete information, which may include: property address and locality details; floor plan/layout of the unit; photographs and/or videos of the interior and exterior of the property; quoted carpet/built-up area; RERA registration number (where available); builder/seller/broker details; and any other documents or information reasonably requested by the Service Provider for the purpose of the assessment.
4.3 The Service Provider shall rely on information provided by the Customer and is not responsible for inaccuracies originating from such sources.
4.4 If material information is missing, inaccurate or subsequently found to be incorrect, the assessment may not accurately reflect the property.
Unless expressly included in the purchased package, the Service does not constitute:
6.1 The layout assessment is intended to provide practical observations regarding the functionality, usability and potential suitability of the property for the Customer's stated lifestyle requirements.
6.2 Such assessment may consider factors including room sizes, circulation, furniture placement, storage, privacy, accessibility, natural light, ventilation, family requirements and other relevant factors.
6.3 Lifestyle suitability is inherently subjective and may differ from person to person.
6.4 The Service Provider does not guarantee that a property will meet the Customer's current or future lifestyle requirements.
7.1 Where Vastu analysis forms part of the Service, the assessment shall be based on the Vastu principles, methodologies and assumptions adopted by the Service Provider or its designated experts.
7.2 Vastu assessment is provided for informational and cultural/personal decision-making purposes only.
7.3 Vastu observations are not scientific, medical, legal, financial or engineering conclusions and should not be treated as such.
7.4 The Service Provider does not represent or guarantee that compliance or non-compliance with any Vastu principle will result in any particular financial, health, personal, professional or other outcome.
7.5 Different Vastu practitioners and schools of thought may interpret the same property differently. The Customer acknowledges this inherent subjectivity.
8.1 The Service does not constitute legal, financial, tax, investment or lending advice.
8.2 The Customer should obtain independent advice from appropriately qualified professionals before entering into any purchase agreement, paying a material advance, obtaining financing or completing a property transaction.
8.3 In particular, Customers are strongly advised to independently verify title, ownership, encumbrances, approvals, RERA registration, sanctioned plans, occupation/completion certificates, tax liabilities, society/association matters and other legal or regulatory matters through qualified professionals.
9.1 The Service Provider does not guarantee that use of the Service will: prevent a financial loss; identify every defect or risk; result in a lower purchase price; result in a profitable investment; increase the resale value of the property; ensure successful resale; identify every legal or technical issue; or result in any particular purchase decision or outcome.
9.2 The final decision to purchase or not purchase a property remains solely with the Customer.
10.1 Certain information used in the assessment may be obtained from publicly available sources, third-party databases, maps, property portals, government sources, developers, brokers or other external sources.
10.2 The Service Provider does not guarantee the accuracy, completeness or current status of information obtained from third parties.
10.3 The Service Provider shall not be responsible for errors arising from inaccurate, outdated, incomplete or misleading third-party information.
11.1 The assessment shall generally be delivered within the timeline communicated to the Customer at the time of purchase.
11.2 Timelines may vary depending upon: completeness of information; availability of required documents; complexity of the property; additional information requests; technical issues; third-party data availability; or circumstances beyond the Service Provider's reasonable control.
12.1 The Customer shall pay the applicable fees for the Service package.
12.2 All fees are exclusive of applicable taxes unless expressly stated otherwise.
12.3 The Service Provider may commence the assessment only after receipt of the applicable payment and required information.
14.1 Cancellation and refund eligibility shall depend upon the stage at which the Customer requests cancellation.
14.2 Unless otherwise specified for a particular Service package:
14.3 Any refund shall be processed in accordance with the Service Provider's prevailing refund policy.
14.4 Nothing in this clause shall limit any rights available to the Customer under applicable law.
The Customer remains solely responsible for:
16.1 All reports, methodologies, frameworks, scoring systems, software, algorithms, designs, content, trademarks, logos and other intellectual property used or provided as part of the Service shall remain the property of the Service Provider.
16.2 The Customer receives a limited, non-exclusive, non-transferable right to use the assessment provided to them for their personal property-purchase decision.
16.3 The Customer shall not reproduce, resell, commercially exploit, distribute, publish, modify, reverse engineer or commercially use the Service Provider's proprietary methodologies, reports or technology without prior written permission.
17.1 The Service Provider may collect and process information provided by the Customer for the purpose of delivering the Services.
17.2 Personal information shall be handled in accordance with the Service Provider's applicable Privacy Policy.
17.3 Property-related information, documents, photographs and other materials provided by the Customer may be retained for legitimate business, quality-control, regulatory, audit and service-improvement purposes, subject to applicable law and the Service Provider's Privacy Policy.
17.4 The Service Provider shall take reasonable measures to protect Customer information but cannot guarantee absolute security of electronic systems or data transmission.
18.1 To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive loss arising from or relating to the Service.
18.2 Without limiting the foregoing, the Service Provider shall not be liable for: loss arising from a property purchase; loss in property value; inability to resell a property; loss of expected appreciation; financing costs; opportunity costs; legal or tax liabilities; construction or structural defects not covered within the Service; title or ownership disputes; defects or issues not identifiable from the information provided; inaccurate information supplied by the Customer or third parties; or decisions made by the Customer based on the assessment.
18.3 Subject to applicable law, the Service Provider's aggregate liability arising from the Service shall not exceed the amount actually paid by the Customer for the specific Service giving rise to the claim.
18.4 Nothing in these Terms shall exclude or limit liability to the extent such exclusion or limitation is prohibited under applicable law.
19.1 Unless expressly stated otherwise, the assessment is not a certificate issued by an architect, structural engineer, registered valuer, advocate, chartered accountant, surveyor, government authority or other statutory/professional authority.
19.2 Any scores, ratings, recommendations or classifications provided through the Service are proprietary analytical outputs and should not be interpreted as statutory or professional certifications.
The Service Provider shall not be liable for any delay, interruption or failure to perform the Services caused by circumstances beyond its reasonable control, including but not limited to natural disasters, governmental restrictions, technical failures, internet or telecommunications failures, cyber incidents, strikes, civil disturbances, epidemics, war or other force majeure events.
21.1 The Service Provider reserves the right to modify, improve, suspend or discontinue any feature of the Service.
21.2 Any material change affecting an already purchased Service shall be handled reasonably and, where appropriate, the Customer may be offered an alternative or applicable refund.
22.1 The Service may contain references to or rely upon third-party services, platforms, databases, maps, property portals or other external resources.
22.2 The Service Provider does not control and is not responsible for the availability, accuracy, content, policies or performance of third-party services.
The Customer represents that: all information supplied to the Service Provider is accurate to the best of the Customer's knowledge; the Customer has the authority to provide documents and information submitted for evaluation; the Customer will not use the Service for any unlawful purpose; and the Customer will not misrepresent the Service Provider's assessment as a legal, financial, valuation or statutory certification.
24.1 The Service Provider and Customer shall endeavour to resolve any dispute amicably through good-faith discussions.
24.2 If the dispute cannot be resolved amicably within 30 days, the dispute shall be subject to the dispute-resolution mechanism specified by the Service Provider, including arbitration where applicable and legally permissible.
24.3 The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time.
24.4 The seat and venue of arbitration shall be Mumbai, Maharashtra, India, unless otherwise agreed in writing.
24.5 The language of arbitration shall be English.
These Terms shall be governed by and interpreted in accordance with the laws of India. Subject to the dispute-resolution provisions above, the courts at Mumbai, Maharashtra shall have jurisdiction over disputes arising out of or relating to the Services.
Nothing contained in these Terms is intended to restrict, exclude or waive any mandatory rights or remedies available to the Customer under applicable Indian law.
If any provision of these Terms is held to be invalid, illegal or unenforceable, such provision shall, to the extent possible, be interpreted or modified so as to give effect to its intended purpose, and the remaining provisions shall remain valid and enforceable.
These Terms, together with the applicable Service description, pricing, order confirmation, Privacy Policy and any other terms expressly incorporated by reference, constitute the entire agreement between the Service Provider and the Customer concerning the Service.
